  1. Eligibility: FREE SPIRIT JEANS TWITTER JEAN-A-DAY GIVEAWAY “Sweepstakes” (“Sweepstakes”)    is open and offered only to legal residents of the contiguous Continental United States, who are 21 years of age and older at the time of entry. Employees of Free Spirit, the participating websites, their respective subsidiaries and affiliated companies, advertising, promotion, or production agencies, web masters and web suppliers (and their respective IRS dependents, immediate family members and individuals residing in their same household) are not eligible to participate. Void in Alaska, Hawaii and where prohibited by law.  All applicable federal, state and local laws apply.  By participating, all entrants agree to be bound by these Official Rules.

 

  1. To Enter: During the Entry Period (defined herein, i.e. each day) visit  www.freespiritjeans.com and complete and submit the official Web page entry form, name, date of birth, email address, daytime phone number and Twitter name.  The FREE SPIRIT JEANS TWITTER JEAN-A-DAY GIVEAWAY “Sweepstakes” link or banner on the participating website is clicked.  By filling out and submitting the email entry, consumers are automatically entered into the Sweepstakes.  The Sweepstakes begins each day at 12:00 a.m. Eastern Time (“ET”) and entries must be received no later than 11:59 p.m. ET the same day (“Entry Period”). Administrator’s computer will be the official clock for the Sweepstakes. Any other attempt at email or Internet entry is void.

    Limit one (1) entry per person for this Sweepstakes. Participants may not enter with multiple email addresses, nor may participants use any other means to enter multiple times, and any entrant who does so, or otherwise attempts to enter multiple times will be disqualified. Released Parties (as defined below) are not responsible for illegible, lost, late, damaged, incomplete, misdirected, or stolen entries; or for lost, interrupted or unavailable network, server, satellite, Internet Service Provider (ISP), website or other connections, availability or accessibility; or for miscommunications, failed computer, telephone or cable transmissions, lines, or technical failure; or jumbled, corrupted, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind whether human, mechanical, electronic, technical or network; or for the incorrect or inaccurate capture of entry or other information or the failure to capture any such information.

 

  1. Drawing: Winners will be selected in a series of random drawings to be held each day (unless time frame is changed by Sponsor), from among all eligible entries received by the participating web sites, by Administrator, whose decisions are final and binding in all matters relating to this Sweepstakes. One (1) Jean winner will be picked each day.  Odds of winning in a specific random drawing depend on the number of eligible entries received for the specific random drawing.  The potential prize winners will be notified by email or phone using the email address and daytime phone number provided at the time of entry. Sponsor is not responsible if any potential winner notification is not received for any reason. Failure of the potential prize winners to respond within five (5) days from such notification referred to above may result in forfeiture of the applicable prize and the selection of an alternate prize winner. An alternate prize winner will be selected in the event a prize cannot be awarded to the potential prize winner drawn. In the event of non-compliance with these Official Rules by a potential prize winner, an alternate prize winner may be selected. Sponsor will successively attempt to contact up to two (2) potential winners of each prize in accordance with such procedure, and if there is still no confirmed winner of the prize in question after such attempts have been made, the applicable prize may go un-awarded.  Each potential prize winner may be required to execute and return an Affidavit of Eligibility/Liability Release and (where legal) a Publicity Release (collectively, “Prize Claim Documents”) within five (5) days of receipt of such Prize Claim Documents, or the applicable prize may be forfeited in its entirety and an alternate winner may be selected.  Noncompliance within this time frame and these Official Rules will result in disqualification.  Prize winner’s guests will each be required to execute and return a Liability Release within a stated deadline. If a guest is the minor (“Minor”) child or legal ward of the Prize winner, Liability Release must be executed on behalf of the Minor by the Prize winner.

 

  1. Prizes: First Prize - One (1) Prize Winner will receive one pair of Free Spirit Jeans (as seen on the Free Spirit Jeans website). Winner is responsible for all federal, state and local taxes, meals. Guests must be 21 years of age or older as of winner notification, unless they are the child or under legal guardianship of the winner.  Prize cannot be exchanged for cash or changed in any way.  If winner is unable to accept the prize as stated, prize will be forfeited in its entirety and another winner may be selected at Sponsor’s discretion.  Winner is responsible for all federal, state and local taxes.

Approximate Retail Value of Grand Prize: $59.00.

One (1) Prize Winner will be selected from among eligible entries received from each participating website stated above and will receive one (1) pair of Free Spirit Jeans (Approximate Retail Value of each First Prize: $59.00).  No transfer, substitution or cash prize will be awarded in lieu of stated prize except by Sponsor who reserves the right to substitute prize, or any part thereof, with a prize of equal or greater value.

  1. Conditions Of Participation: Participants agree that: (a) Sponsor, Administrator and their respective parents, subsidiaries, and owners of the participating web sites, affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, shareholders, representatives and agents (collectively the "Released Parties") will have no liability whatsoever for and shall be held harmless by participants for any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of or inability to use any prize or from participation or inability to participate in this Sweepstakes, including any travel or Sweepstakes related activity, (b) Released Parties will have no liability whatsoever for failure to supply a prize or any part thereof, by reason of any acts of God, any severe weather, hurricane, flood, fire, war, transportation interruption of any kind, or any other cause beyond their control, (c) except where legally prohibited, winner grants (and agrees to confirm that grant in writing) permission for the Released Parties and those acting under their authority to use his/her name, photograph, voice, statements and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide, including, without limitation, on the World Wide Web, without notice, review or approval, (d) if any prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and an alternate winner may be selected at Sponsor’s discretion, (e) noncompliance with any of the foregoing may result in disqualification and awarding of prize to an alternate winner as determined in the sole discretion of the Sponsor. Federal, state and local taxes and all other expenses not specified herein are winner's sole responsibility.
  2. Limitations on Liability: Persons who tamper with or abuse any aspect of the Sweepstakes or any website, as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant's eligibility. Should any portion of the Sweepstakes be, in Sponsor's or Administrator’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes, and select winner from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Released Parties are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, technical failure, theft or destruction, or unauthorized use of any technology used in connection with this sweepstakes. In the event of a dispute regarding prize claims or entries received from multiple users having the same e-mail account, the authorized account subscriber of the email account at the time of entry used to enter will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses. Any use of micro, automatic, programmed, robotic, or like entry methods will void all such entries by such methods, and entrants using such methods will be disqualified.
